Note to purchase of good faith


All canines have the potential for genetic or congenital disease. Unfortunately, due to the nature of some diseases, they cannot always be eliminated. It is the job of the Breeder, through selective breeding, to try and minimize (not eliminate) these conditions -- in good faith. Please read, to your full understanding, the following sections of this Health Guarantee and Sales Agreement concerning any contagious or hereditary defects.  

Pup Post shall hereinafter be referred to as the “Seller”. The original purchasing party, and solely the original purchasing party shall hereinafter be referred to as the “Purchaser”.  


What is covered under the Health Guarantee?


Before your puppy comes home he or she has undergone an extensive veterinary health check and his/her breeder has followed our vaccination and deworming protocols. This guarantee covers health issues that may arise after the arrival of your puppy. This guarantee only covers puppies who are delivered and have continually resided within the United States and/or Canada

  1. Puppies are sold with a 10 day money back Health Guarantee against death caused by Parvo or Distemper, this Health Guarantee starts on the day of arrival to Purchaser. The Purchaser must have the puppy examined by a licensed veterinarian within 72 hours of receipt of the puppy. A copy of the examination results must be sent to Seller by email within 48 hours of receipt of the examination, failure to provide examination results will render this Health Guarantee null and void. Seller will not accept any examination(s) performed or diagnosis' given by/from any Banfield Veterinary Clinic.  
  2.  If within one year from the date of arrival from Seller, your dog is found and certified by two duly licensed doctors of veterinary medicine (any reference herein to a "veterinarian" shall be assumed to mean a "licensed doctor of veterinary medicine") of your choosing to have a congenital or hereditary condition which adversely affects the health of the dog, and if Seller is notified within five business days of the first veterinarian's determination, Seller will provide reimbursement of reasonable, documented, actually incurred veterinary expenses associated with such diagnosed condition up to the purchase price of your puppy.
  3. The Purchaser is responsible for the daily health care and maintenance of the puppy, including all immunizations and examinations recommended after purchase, as well as providing necessary medication and follow up treatments from veterinarian visits. In order for the Health Guarantee to remain in effect Purchaser must keep receipts and records to verify that they have regularly taken the puppy to a licensed veterinarian for checkups and all required immunizations. If Purchaser does not follow through with immunization requirements and regularly scheduled veterinarian visits the Health Guarantee will be void. 
  4. The puppy must be kept in good physical condition. If said puppy is found to have a life threatening genetic defect within the first year a statement from two duly licensed veterinarians of Purchaser's choosing confirming such an event and cause is required before any action will be taken by the Seller. Seller reserves the right to request a third opinion by a veterinarian of Seller's choosing to determine the genetic defect.
  5. The Cost of regular veterinary care, food, medicine, supplements, training, grooming, cleaning, or other costs of raising and owning a puppy is not covered. The Purchaser is aware that owning a puppy means frequent visits to a veterinarian and understands that he/she will be responsible for all payments.  
  6. This Health Guarantee does not cover any of the following treatable conditions after the 5 day guarantee: Intestinal parasites (Coccidiosis, Giardia, Tapeworms, Hookworms, Roundworms or Whipworms).
  7. This Health Guarantee does not cover Kennel Cough, Pneumonia, Ear or Skin Mites, Mange (Demodectic, Sarcoptic or Cheyletiella), Cherry Eye, Allergies  (food or skin), Herniation (Inguinal, Perineal or Diaphragmatic), Stenotic Nares, Small Trachea, Entropian, Elongated Soft Palate, Undescended Testes, Luxated Patellas grade 1-3.
  8. This Health Guarantee does not cover any veterinarian costs associated with spaying or neutering, including undescended testes. This health guarantee does not cover elective surgeries such as stomach tacking or Juvenile Pubic Symphysiodesis. Seller does not guarantee against nonlife threatening illnesses common to puppies. 
  9. In the unlikely event of the death of the puppy within one (1) year of date of delivery due to genetics, the Seller shall replace the puppy with another puppy of equivalent value within 120 days. All registration paperwork must be returned to the Seller before replacement puppy is sent. If the Purchaser declines the replacement puppy, then the Seller and Purchaser shall be under no further obligation and it will be deemed that the Purchaser has released the Seller from any and all further claims. 
  10. This Health Guarantee is forfeited if the puppy is fed a raw or homemade diet, puppy must be fed an age appropriate premium brand puppy food for the first year. 
  11. This puppy is being sold as a pet/companion only; no guarantee is made as to the disposition, conformation, temperament, size, weight, color and markings or breeding ability of the puppy. No guarantee is made as to the speed with which the puppy will house train or train in any other capacity. No guarantee is made for any other traits that may develop as the puppy grows up. Health Guarantee is null and void if the puppy is used for breeding before this guarantee expires. 
  12. The Seller makes all transportation arrangements. Sometimes travel arrangements are delayed due to temperature restrictions, weather, logistics, mechanical failure or other unforeseen events. The Seller shall not be liable directly or indirectly for any delays which may cause inconvenience or financial loss, nor shall the delay be cause for cancellation. The Seller will collect all transportation fees from the Purchaser at the time of the purchase. Transportation costs are non-refundable.  
  13. The value of the puppy for the purpose of this Health Guarantee and Sales Agreement is solely the original purchase price of the puppy and does not include transportation costs, health certificate, medical bills or any additional costs declared by the Purchaser. Transportation costs cannot be refunded. 
  14. The Seller reserves the right to refuse, terminate or suspend this sale at any time if the Seller deems the transaction is not in the best interest of the puppy. In this case all monies will be refunded to the Purchaser. 

Purchaser Obligations


YOU MUST FULFILL THESE OBLIGATIONS, AS EXPLAINED HEREIN, OR THIS HEALTH GUARANTEE WILL TERMINATE AND BECOME NULL AND VOID.

  1. All our puppies come with our 1-year Health Guarantee. Benefits derived from this Guarantee are dependent on timely vet visits and complete medical records being provided to PupPost. We strongly encourage all responsible new puppy owners to take their puppy to the vet as close to arrival as safely possible. This will allow your vet to get to know your new puppy's vaccine schedule and get a care program started. This is also a recommendation as your new pup will have just changed environments from breeder to your home. Getting a checkup right away helps the transition go as smoothly as possible.
  2. No Vaccines for 10 Days: Your puppy will arrive up to date on vaccinations. To avoid over-vaccination, you should not vaccinate the puppy within the first ten (10) days after your puppy's arrival unless otherwise noted by the breeder.
  3. No Dog Parks and other places (not limited to i.e. Pet stores, parking lots, etc.) where the puppy will mingle with unknown dogs: Puppies without a complete set of vaccinations should not be attend a dog park until such vaccinations are completed nor be associated with any other dogs. This typically occurs at 16 weeks of age.
  4. Regular Veterinary Care: You must visit a licensed veterinarian on a regular basis and ensure your dog receives proper health checkups and timely inoculations.
  5. Appropriate exercise: All dogs need regular exercise and stimulation. You should speak to your veterinarian about the appropriate amount of exercise for your particular puppy at each stage of its life. In particular, you should be careful to avoid over-exercising your puppy during its growth period.
  6. Healthy Diet: Your puppy will arrive with information about the type of food it has been fed so far [and a small amount of that food if any is left from transport]. If you plan to transition to a new food, you should do so gradually to allow your puppy a chance to acclimate to the new food. You should follow a recommended nutritional program, including feeding only premium dog foods and veterinarian approved supplements. You should be careful not to under or over feed your puppy and, in particular, if your puppy's breed is prone to hip dysplasia be careful not to over-feed your dog.
  7. No breeding: Your puppy is intended to be a companion dog; do not breed your dog. If your dog is bred, this Health Guarantee shall terminate and become null and void. Your puppy should be spayed or neutered at an age deemed appropriate by your veterinarian.

How to file a claim


If you have complied with the requirements in this Guarantee and your puppy experiences a health issue that you believe may be covered under this Guarantee, you should notify Pup Post immediately by emailing us at Pup PostLLC@gmail.com us at (720) 402-7062. If possible, you should include a copy of the health records associated with your puppy's diagnosis and any other information you have about the health issue. After receiving the information you have provided, Pup Post will work with you to obtain any additional information we need to review your claim. In case of severe knee, elbow or hip dysplasia, the radiograph should be permanently identified in the film emulsion with: registered name and/or number, name of the veterinarian or hospital making the film, date of radiograph taken. Furthermore, the radiograph and report must meet the standard submission requirements of the Orthopedic Foundation for Animals. Once Pup Post has received all necessary documentation regarding the diagnosis and associated costs, including a necropsy if the puppy passes away, a member of the Pup Post Health Team will review your claim and determine whether and to what extent it is covered under this guarantee. Because of the detailed nature of the documentation needed to review these claims, this process can take several days to complete.

Pup Post reserves the right to, at any time during the claim review process, obtain an additional opinion by a veterinarian of Pup Post's choosing to review any diagnosis submitted in connection with a claim under this guarantee.


Who can file a claim?


Only the original purchaser of the puppy from PupPost can file a claim under this Guarantee. In other words, this guarantee is not transferable to any new owner.


How does state law apply?


This guarantee gives you specific legal rights, and you may also have other rights which vary from state to state.


What if we have a dispute?


FOR THE AVOIDANCE OF ANY DOUBT, THE TERMS AND CONDITIONS OF SALE RELATING TO MANDATORY ARBITRATION SHALL APPLY TO ANY CLAIMS ARISING UNDER, OR RELATING TO, THE TERMS OF THIS HEALTH GUARANTEE.

If you are entitled to a credit and decline to use such credit, Pup Post shall be under no further obligation and it shall be deemed that you have released Pup Post from any and all further claims and waived any rights to pursue any claims against Pup Post.


Definitions


Veterinarian – A doctor of veterinary medicine licensed by the applicable state licensing authority.

Purchase Price – The "Purchase Price" of the puppy is simply the purchase price and does not include taxes, shipping, health certificate and veterinarian costs, shipping crate or any additional costs or expenses incurred or asserted by the purchaser.
